I was on my clubs site and saw this, it's written by Simon Brown, a very well respected guy in the world of 3D.

Members
You may notice that in the right hand forum list we had initially had two competition forums for 3dx and 3dm above the others.
We have been instructed to remove all content from our home pages re these events and all other references on the outside, links and associations.

We have made no associations or links but we did have forums with the event titles.
This have had to be moved and placed within Competitions.
So if you were following these threads, please redirect your focus to inside the competitions forum.

Then there is this:

You may not have read the 3dmasters forum, so I must post in our main forum area so that members are aware of our current situation.

We have been advised that 3dmasters is a registered trademark and therefore we are requested to remove video footage that we took at the recent 2007 3dmasters.

We were not aware that showing such footage on our site as a non commertial venture was an infringment of such laws, and therefore we had no intent to do harm to 3dmasters or any of it's associates.

As requested content as been removed. We have not been asked to remove all forum references at this time and hope that free speach within our site can remain without further legal issues arrising.

Please understand that MHC are unable to discuss this further with members, but please accept our appologise. Both to 3dmasters for showing footage of their event without permission and to our members for removing interesting content on our site.

We wll continue to video flying events around the UK other than 3dm and 3dx, and will be sure to gain permission from these future events prior to taking the footage.

Then I wrote this :
I agree with you **** matey, as long as he makes a quick buck or 2, that's all that man cares. There was no signage at the 3DM stating that no video equipment or camera equipment should be used nor were there any copyright laws mentioned by the man in question (JB)

So Therefore the people who videod the event did so at their own FREE WILL, therefore the aforementioned Video clips belong to the person who took them andNOT 3DM. So Mr Barringer take your head out of the clouds and do something for the good of the sport and NOT yourself and allow these people access to their own video footage of the event.




This post was written by me with NO outside influence , so, anything regarding this post should be directed at me and no one else.

I wonder if Mr Barringer can explain this or hasn't he got the guts to confront the people asking questions

You could post the video and just not use the name "3D Masters". That's all the trademark would protect.

From their website:

Under UK Law (Trade Marks Act 1994 - amended since) this means that you can't use the phrase ‘3D Masters’ on the types of item listed above.

So, no Airshows, Clothing, Printed Matter or Audio Visual recordings.

However, you can show 3D Masters videos, so long as yo don't specifically use that phrase.

How do you know which event? or was the video advertised as "a model helicopter flying competition in Northampton"?

I would change the name to "Barringer's All Male Review" and put the videos back up. Also ask his sponsors how they feel about his limiting the ways their products can be displayed this way.

I guess as we can't talk about the two+1 c+1 expert+1 (tm), then it follows it should have no bearing on the world of model helicopter competitions and be of no importance. How can it be important if you can't legally utter its name?

I don't really know what the legal interpretation should be - I'm not a lawyer after all.

I own an Apple Mac computer (I don't think Apple will object to me saying that).

I use Microsoft Windows on my PC (I don't think Microsoft will ojbect to me saying that either)

I fly a Hirobo Sceadu helicopter. (No complaints from Hirobo) - they even gave me some free stickers. There's a picture of it on my Flickr photos page.

I went to 3D Masters, saw no "No Photography" Signs, and so did some.

I've put my a few of my photos from the event in my Flickr photo stream. I'll add some more soon.

In my humble opinion, I'm promoting the tradenames, not taking revenue away from them. If you see my photos, or indeed someone else's videos, it might just inspire you to go to the event, or maybe buy the official DVD.

If you went around selling your videos and branded them as "Official 3D Masters Coverage", then if I were Jeff I'd be upset with you. I don't know where the grey line sits.

All they are worried about is possible loss of sales from the official Lance DVD if too many vids appear of the main flying

I would never buy the DVD anyway,several copies of the official DVD normally freely pass around anyway

If they choose to keeps this up I would hope the sponsors the take notice and stop sending their pilots to this event. If we can't see their heli's fly in the top rated events then why would we want to buy them? Maybe it is time the sponsors find or create a new event that does not hide behind trademarks to make more money for the event. Say the World Masters of Heli in Las Vegas, NV

Just more proof that the upper levels of 3D competition (what little competition there is) is all about the cash, from the organizers to the competitors to the manufacturers. Everyone shows up for XFC and 3DM, yet no one shows up for the 3D contest at the US Nationals, a ground floor oppurtunity to create a 3D competition for ANYone....the difference? Prize money.

What really got under my skin was on the Friday of the 3DM it was raining really hard and all flying was cancelled but they where still charging people to get into the field. I saw people turn away and refused to pay because of no flying, I am sure the Traders that where there would be trilled with that.
