Has anybody noticed that the Synergy name that JK intends to use for his Helicopter is also being used by Christophe Paysant Le Roux and calls it a Synergy 90 3D. Are they in colaberation or who has registered their name first with the patents office. Looks a nice plank too for 3D, F3A and runs on a 90 engine.

The name synergy gas been used by alot of different companies. I think
it would fall to the TM trade mark office.

Any and all of those companies will have a hard time trademarking that name. Synergy appears in the dictionary I believe. As such, trying to TM the name is kind of little trying to TM "helicopter", "computer", etc.

Someone with more legal training than I would have to comment.

Well, since people have managed to trademark the word "Windows", I dont see the problem with "Synergy". If my understanding of the US Patent Office is correct, it's more or less a matter of how expensive your lawyers are..

by time the courts had finished with the offense

The bottom line is this that if all these companies can coexist with the same name and not have a problem who are we to interfere with it because they all either are or arent aware of it but if the conflict is there Im sure the comapanies will discuss what to do and come to a fair compromise (remember the "synergy" isnt realeased yet so who knows even though its called that now maybe thats a code name for the prototype until they found a name they liked better I doubt this to be the case however its possible and at this time really none of our concern because we have nothing to either gain or lose by the name sharing as consumers

CPLR has had the Synergy name for at least 4 or 5 years for a range of his designs.
it evolved from his popular Caprise which came before it.
As for Patent?
No idea.

You don't patent names, you patent ideas.

You trademark names. When you trademark them, typically you identify the business arena you plan to use the trademark in. This is why many identical names are in the marketplace, just for different market segments.

Guys

Learning every day between Patent and Trademark but if you were launching a new helicopter would you call it after a plank.

Maybe we should come up with some ideas for JK or does everybody think the name Synergy will market as well as Fury, Raptor, Vigor, Freya etc etc in the arena of competitive 3D aircraft.

I thought the company name was Synergy Model Helicopters and the helicopter was the N9.

As far as trade marks are concerned I would be more nervous using F1 given Bernie Ecclestone's propensity for legal action

I believe that the name F1 came from Morley not QuickUK (budd), QuickUK took over and added all the bling to the F1 in a bid to make it better.

No i think they trademarked the "product" windows, the logo in particular. You cannot trademark a word out of the dictionary.

If you are going to patent something, then you must have some "Intellectual property" this mean something that has not been patented before and something that you came up with.

I dont think there is a problem

Their can be multiple registered trade marks with the same name.

What is required that they be in separate industries such as not to be easily confused. It is this definition of separate that is generally the basis of disputes when two companies try to trade mark the same name. Most companies want their trade mark to be as unique as possible and often try to stretch the separate definition as far as possible.

For example with would be legitimate to have a registered trade marks for Synergy Helicopters, and Synergy Fertilizer. It would not be permissible to have a Synergy RC Helicopter and a Synergy RC Airplane.

I'm familiar with this since my dads company was involved in this sort of litigation and eventually had to change its name.
