| (This is based on things I have learned working in the web industry, but I think the essential elements are the same)
1. I would always have the agreements for use of photographs very formal and written out. Interestingly, unless you sign a specific "work for hire" agreement, then default is that *you* (as the photographer) own the rights to the work. We have to be really careful about this when we hire artists, otherwise we wouldn't own their work.
2. I don't have any direct experience with this, but I think it is still an open issue: See this case for a thorny example. I think in general, though, public building are public buildings, and anyone can take a picture of it and do what they want.
